- Login / Registration
You may need to register an account with username and password (“Account”) with Part of Art in order to use some of the services (which includes online purchases) made available to you on this website (www.partofart.store) (“Website”). If you choose to register theAccount with username and password with part of Art and/or proceed with payment(s)you agree to provide information about yourself and your billing information in a true, accurate, updated and complete manner.
You agree to accept responsibility for all acts, activities and transactions conducted through your Account (including all online purchases via (www.partofart.store) this Website). You are also responsible for maintaining the confidentiality of your account, username and password and shall notify Part of Art immediately should you suspect any unauthorized use of or access to your account. Part of Art shall in no event be held liable for any acts of yours conducted through your account.
You may not authorize any other persons to use your account, username or password.
- Eligibility toOnline Purchase
Part of Art Online Purchase is only available to customers who are 18 years of age or above. Parents should consider installing appropriate parental control tools to prevent your children of underage from submitting information online without parental monitoring.
Additionally, in order to qualify for Part ofStore Online Purchase, you must make payment through the PayPal system and provide personal information (i.e. email address, real name, phone number, billing information, delivery address and other requested information as required to process your Part of Art Online Purchase orders) which are warranted by you to be valid and accurate.
- Payment
You must make payment through the PayPal system (either through a registered PayPal Account or credit card). If you proceed with payment via PayPal®, you will be directed to a different website address operated by PayPal®, part of Art does not endorse nor support the content of such website address. The user agreement for the PayPal® service will govern your use of that service, and you must refer to that user agreement and not these Terms and Conditions to determine your rights and liabilities asa user of the PayPal® services. Once you place an Order (defined below), you’re present and confirm that the PayPal® account used belongs to you and that the same has not been registered or obtained by any fraudulent means and/or unauthorized methods. If your request for payment via your PayPal account is refused or delayed for a process for whatever reason(s), Part of Art shall not beheld liable for any delay or non-delivery of your order. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the currency exchange rates in effect when the charges were incurred. Unless you notify Part of Art of any discrepancies within thirty (30) days after you first receive notice thereof, you agree that they will be deemed accepted by you in all respects and for all purposes. If Part of Art fails to receive payment through the PayPal® service, you agree to pay all amounts due upon demand by part of Art. Our system adopts adequate security measures. Your personal details and passwords are encrypted and such details will be securely stored on our systems. Under no circumstances shall K11 DS beheld liable for any loss you may suffer should any third party procures unauthorized access to any data you provided when using our services. Unless expressly set forth on the Website, Part of Art does not accept any other payment form. If Part of Art offers or accepts any other form of payment, you hereby agree to all restrictions, terms and conditions associated with such other form of payment.
- Taxes
You are responsible for paying any governmental taxes (if any) imposed on your purchases, including, but not limited to, sales, use or value-added taxes. With respect to each of your purchases, Part of Art will automatically charge and withhold any applicable tax (if any) that it deems is required in any applicable jurisdictions.
- Currencies
All transactions conducted by or with Part ofArt are made in Hong Kong Dollars. If your PayPal® account is not denominated in Hong Kong Dollars, the final price charged in your currency will be converted at the exchange rate determined by PayPal® in accordance with the applicable exchange rate on the day your PayPal® account processes the transaction. Please consult the user agreement for the PayPal® service for information regarding the determination of exchange rates. The exchange rates may include amount payable to PayPal®, which may result in the actual price paid being higher than the posted Hong Kong Dollar price.
- LIMITATION OF LIABILITY
l We shall not be liable for any loss or damage whatsoever arising from failure by us to perform the contract/ transaction, whether wholly or in part, which is caused by:
(i) default by our suppliers, or
(ii) any cause whatsoever beyond our control.
l Our liability whether in contract/ transaction orin tort shall in all cases be limited to the amount of the invoice to which the claim relates.
l In no circumstances whatsoever shall we be liable for indirect or consequential loss or loss of profits.
- DATES FOR DELIVERY
The package may be presented to the recipient will depend on the postal service provided in the designated country. Most of the time packages are delivered by postman to the address and require the recipient to sign to receive the package. However, this may not be applicable to some countries or particular areas in the country and recipients may sometimes be required to pick up the package from the postal service's office. Please contact the national postal service of your country to check the way packages are delivered.
Since shipping is often affected by the processing time of the Customs and delivery standard in the destination country, the estimated delivery date indicated on the Web site is strictly for reference only and shall not be regarded as a commitment. Part of Art does not guarantee orders to be delivered by a particular time, and shall not be liable for any direct/indirect loss caused by delivery issues.If there is a necessity to check the status of the article in the destination country with local postal service, you will need to carry out the enquiry on your own and Part of Art will not be responsible for any fees (such as communications)incurred.
Orders may or may not entitle free shipping.For the free shipping offer that Part of Art provides, the type of delivery to be adopted will be "Standard Shipping" unless otherwise specified.Free shipping will be applicable only to the purchase above $500 in Hong Kong or other promotion issue. All shipping fees paid are non-refundable.
- GOODS OFFERED EX-STOCK
When delivery of goods is offered ex-stock the offer is subject to the goods being available and unsold at the time of receipt by us of an order.
- PRICES
(a) The orders placed on the Website are subjecting to being charged with import fees, taxes, custom duties, related package handling fees and/or any other relevant charges required by the corresponding designated country and/or the organization(s) that handle(s) the shipment / delivery of the orders. None of these charges is included in the price that you pay on theWebsite. Items cannot be sent as gifts, and your purchase may or may not have these charges, depending on the policies of the designated country and/or the organization(s) that handle(s) the package. If any of the said charges apply, you may need to pay for them to the respective collection authority in advanceof receiving your purchase. You should check with any related authority of your country (or the designated country of the order) for any charges required to receive the goods you order from Part of Art. Part of Art is not responsible for any of these charges, and would not refund on item(s) returned to us due to unaccepted/undelivered and/or any other reasons unless otherwise agreed with Part of Art in advance.
- LOSS OR DAMAGE
In the event of any loss or damage or delay to any goods delivered a tour risk to the buyer or otherwise to his order notice of the same shall be given to us in writing by the buyer forthwith upon delivery (or, in the case of the loss of any goods, at the time when the goods should have been delivered)and the buyer shall at the same time take all necessary steps to notify the carrier in writing of any such loss damage or delay and shall in all cases where possible enter a note of the same upon the carriers receipt. If by reason of the failure of the buyer to give any such notice we are precluded from making a recovery from the carrier in respect of the loss or damage or delay complained of then we shall not be liable for any claim by the buyer in respect thereof and the buyer shall be liable to pay for the goods as though no such loss damage or delay had occurred.
- GOODS CLAIM
(a) Any claim by the buyer which is based on any defect in the quality or condition of the goods or their failure to correspond with specification or non or incorrect delivery shall (whether or not delivery is refused by the buyer) be notified to the seller within 7 days from the date of delivery or (where there is non or incorrect delivery or the defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure.If delivery is not refused, and the buyer does not notify the seller accordingly, the buyer shall not be entitled to reject the goods and the seller shall have no liability for such defect or failure, and the buyer shall be bound to pay the price as if the goods had been delivered in accordance with the contract.
(b) Where any valid claim is notified to the seller, the seller shall be entitled to repair or replace the goods (or the part in question) free of charge or, at the seller’s sole discretion, grant credit to or refund to the buyer the price of the goods (or a proportionate part of the price), but the seller shall have no further liability to the buyer.
- Right of Termination
We reserve the right to suspend or cancel your Part of Art account at any time, without prior notice and at our sole discretion if you break any of your obligations under the Terms and Conditions. If you wish to terminate your Part of Art account, you may inform us in writing at partofart@antalis.com.Suspension or cancellation of your part of Art account shall not affect our and your rights and liabilities accrued before such suspension/cancellation. All provisions of the Agreement (in particular, the Terms and Conditions), which by their nature shall survive termination of the Agreement, including, without limitation, intellectual property, representations and warranties, indemnification, disclaimer of warranties, and limitations of liability.
- Site Errors
In the event a product is listed on the Website at an incorrect price or with incorrect information, orders for such products will be revised to reflect the correct price or information. We reserve the right to reject any orders placed on the site.
- Change of Privacy Policy
This Privacy Policy Statement may from time to time be updated, revised and changed. Any change, update or modification will be effective immediately upon being posted on Part of Art’s Website. You are advised to refer to the latest version of this Privacy Policy.
- CONSTRUCTION
Where the context admits:
(i) the singular shall include the plural and vice versa;
(ii) the male gender shall include the female gender and vice versa;
(iii) the term 'person's hall include a corporate as well as an unincorporated person.
- GOVERNING LAW
The validity construction and performance of the contract shall be governed by the laws of Hong Kong and both parties shall submit to the non-exclusive jurisdiction of the Courts of Hong Kong.
